    Description:

    For purposes of refinancing, ACC performed a Phase I Environmental Site Assessment (ESA) to evaluate for the presences of environmental impacts to the Subject Property so that the Client could obtain Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) liability protection (42 U.S.C. §9601).  The Phase I ESA was conducted in accordance with the standards established under American Society for Testing and Materials (ASTM) Standard Practice E1527-05, “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process.”  This ASTM practice was designed to incorporate the United Sates Environmental Protection Agency (US EPA) established federal standards and practices for conducting “all appropriate inquiries” (AAI) and the finalized AAI guidelines.

    In accordance with the ASTM standard, the Phase I ESA was performed to identify recognized environmental conditions (RECs), historical recognized environmental conditions (HRECs), and business environmental risks (BERs) by means of reviewing reasonably ascertainable regulatory agency records (including the California Regional Water Quality Control Board’s “GeoTracker” online database, the California Department of Toxic Substances Control’s “Evirostor” online-database, Local Oversight Program databases, etc.), city and county building department records, and historical documents covering the Subject Site such as aerial photographs, topographic maps, Sanborn fire insurance maps and historic city directories.  ACC utilizes database packages produced by EDR, Inc., but verifies information and typically conducts research beyond the scope of the data provided by EDR.

    All components of this ESA were performed or overseen by Environmental Professionals as defined in the AAI Standards and ASTM E 1527-05.  No RECs, HRECs or BERs were observed at this property.
